These terms are an agreement between you and Ekdutn Inc. for requesting and receiving a free first inspection through wahan.app. By sending a request you agree to them. If you do not agree, please do not send a request.
1. Who we are
Wahan is operated by Ekdutn Inc., a corporation incorporated under the Canada Business Corporations Act (corporation number 1818608-1), with its registered office in Ontario, Canada. "Wahan", "we", "us" and "our" mean Ekdutn Inc. Your agreement is with Ekdutn Inc. alone, and no director, officer, shareholder, employee or contractor is personally a party to it.
2. The free first inspection
- One visit to one property in Faisalabad district: a plot, house, farmland or family grave, and one photo report.
- It is free. We do not ask for a card, and you have no obligation to buy anything afterwards.
- We may decline or cancel a request, for example if the property is outside our area, cannot be identified from the details given, is not safe to visit, or we have more requests than we can handle. We will tell you if we do.
- Timing depends on inspector availability. We confirm the visit with you by email.
- Paid services, when we offer them, will have their own terms and prices at that time.
3. How we inspect
- We photograph from public land only: the road, street or public path next to the property. We never go inside, climb walls, open gates or step onto anyone else's land.
- We do not speak for you. We do not talk to occupants or neighbours on your behalf, make claims about who owns the property, or confront anyone.
- If anyone is present, or our inspector is challenged or feels unsafe, the inspector may take one photo from the road if it is safe to do so and leave. The visit may end early, and the report will say so.
- We do not visit after dark.
- Photos follow our photo policy.
4. What the report is, and what it is not
The report is a record of what could be seen from public land at the date and time on each photo. It is not a land survey, a boundary demarcation, a title or ownership check, a building or structural inspection, or legal advice. It cannot show what is not visible from public land, and conditions can change after the visit.
We identify the property from the details you give us. If they are wrong or incomplete we may photograph the wrong property, and we are not responsible for that.
5. Your responsibilities
- Give us accurate information about yourself and the property.
- Only request an inspection of property you own, or that you are a family member of the owner or have the owner's permission to ask about.
- Do not ask us to do anything unlawful or unsafe, and do not use a report to harass, threaten or harm anyone.
6. Using your report
You may keep your report and share it with family, advisers or a lawyer. Please do not edit the photos or remove their date, time and location. An edited photo no longer matches the digital fingerprint we recorded, which is what makes the photo trustworthy.
7. No warranties
The free inspection and report are provided "as is". To the fullest extent the law allows, we make no promise that a report is complete, free of errors, or suitable for any particular purpose, and we do not guarantee that we can carry out any requested inspection.
8. Our liability
To the fullest extent the law allows, we are not liable for indirect or consequential loss, loss of profit or opportunity, or any loss arising from a dispute about a property or from someone else's actions on it. Because the first inspection is free, our total liability to you for anything arising from it is limited to CAD $100.
Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Some places do not allow these limits, so parts of this section may not apply to you.
9. Privacy
Our privacy policy explains how we collect and use your information, and forms part of these terms.
10. Changes
Wahan is a new service. We may change or stop the free inspection offer, or update these terms, at any time. We will update the date at the top of this page. Changes do not affect a visit we have already confirmed with you.
11. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction over any dispute. If you are a consumer, this does not take away any right you have under the mandatory consumer protection law of the place where you live.
